We reserve the right to refuse service, cancel orders, restrict access, or terminate accounts in accordance with these Terms and applicable law.

Keystone Spa Covers reserves the right to update, modify, or replace these Terms at any time.

Keystone Spa Covers sells custom-manufactured hot tub covers, Quick Ship spa covers, replacement covers, spa accessories, and related products.

We make reasonable efforts to accurately represent our products, including their dimensions, colors, materials, specifications, features, and availability.

However, product photographs, illustrations, diagrams, descriptions, and other visual representations are provided for general reference purposes.

Actual product appearance may vary slightly due to lighting, display settings, manufacturing tolerances, material characteristics, or supplier variations.

Minor cosmetic differences that do not materially affect product function or agreed specifications do not automatically constitute a product defect.

We reserve the right to correct product information, modify specifications, discontinue products, change prices, and update product availability without prior notice.

If an order contains a material pricing or listing error, we may cancel the order and refund any payment collected for the canceled items.

5. Custom Spa Covers and Customer Measurements

Many Keystone Spa Covers products are custom-manufactured according to measurements, specifications, or options selected or approved by the customer.

CUSTOMERS ARE SOLELY RESPONSIBLE FOR VERIFYING THE ACCURACY OF ALL MEASUREMENTS AND PRODUCT SPECIFICATIONS BEFORE SUBMITTING AN ORDER.

This includes, but is not limited to:

  • Cover length and width;

  • Corner radius and corner configuration;

  • Cover shape;

  • Hinge and fold direction;

  • Skirt length;

  • Strap location and length;

  • Handle placement;

  • Cutouts and special configurations;

  • Foam thickness and taper;

  • Material and color selection;

  • Additional insulation or customization options.

Spa Model Database and Sizing Tools

Keystone Spa Covers may provide brand and model selection tools, sizing charts, reference dimensions, measurement diagrams, and automated product configuration resources.

These tools are provided for convenience and informational purposes only.

Spa manufacturers may modify dimensions, cabinet designs, shell configurations, or other specifications without notice.

Different production years of the same spa model may have different dimensions.

Additionally, existing spa covers may stretch, shrink, warp, or become distorted over time.

Therefore, selecting a spa brand and model does not guarantee that a replacement cover will fit without independent measurement verification.

Customers must physically measure their spa and confirm all dimensions before ordering, even when selecting a cover using our brand and model database.

Keystone Spa Covers is not responsible for fit issues arising from inaccurate, incomplete, inconsistent, or unverified customer-submitted measurements or product selections.

A cover manufactured according to the measurements and specifications submitted or approved by the customer will be considered correctly manufactured for purposes of our voluntary return policy, even if those specifications do not match the customer's spa.

This provision does not exclude rights relating to manufacturing defects or products that fail to conform to the customer's approved specifications.

Measurement Clarification

Keystone Spa Covers may contact customers regarding unusual dimensions, incomplete information, or questionable specifications.

However, we are not obligated to independently verify customer measurements or identify potential ordering mistakes before production.

Failure to identify an error does not transfer responsibility for customer-submitted specifications to Keystone Spa Covers.

6. Custom Orders — Final Sale

ALL CUSTOM-MADE AND MADE-TO-ORDER SPA COVERS ARE FINAL SALE.

Because custom spa covers are manufactured specifically according to customer-selected specifications, they are not eligible for voluntary returns, exchanges, or refunds due to:

  • Incorrect measurements;

  • Incorrect spa brand or model selection;

  • Incorrect shape or corner radius;

  • Incorrect skirt, hinge, or strap configuration;

  • Incorrect material or color selection;

  • Customer ordering mistakes;

  • Changes in preference;

  • Accidental purchases;

  • Failure to verify dimensions;

  • A cover not fitting due to customer-submitted specifications.

Once a custom cover has entered production, cancellation or modification is generally not permitted.

We may accommodate requests before production begins at our discretion.

These restrictions do not eliminate applicable warranty rights, statutory cancellation rights, or remedies for manufacturing defects or errors attributable to Keystone Spa Covers.

All custom orders are additionally governed by our Return & Refund Policy.

7. Quick Ship Spa Covers

Quick Ship Spa Covers are manufactured in predetermined dimensions and specifications rather than individually customized for each customer.

Eligible Quick Ship Spa Covers may be returned subject to our Return & Refund Policy.

Unless otherwise stated:

  • Returns must be initiated within 10 calendar days of order receipt.

  • Returned products must arrive at our designated return location within 30 calendar days of the original delivery date.

  • Customers are responsible for return shipping and transportation costs.

  • Covers must be unused, uninstalled, undamaged, and in original resaleable condition.

  • Returns require prior authorization.

Original shipping or delivery fees are generally non-refundable for ordinary customer-initiated returns.

Keystone Spa Covers reserves the right to refuse voluntary returns that do not meet the established return requirements.

Returns involving verified defects, shipping damage, fulfillment errors, or other legally protected circumstances will be handled in accordance with applicable law and our relevant policies.

8. Accessories and Free Returns

Eligible accessories purchased from Keystone Spa Covers qualify for free returns within the contiguous United States, subject to the following conditions:

  • A return request must be initiated within 10 calendar days of order receipt.

  • Merchandise must be received by Keystone Spa Covers within 30 calendar days of the original delivery date.

  • Products must be unused, uninstalled, and in original resaleable condition.

  • All original accessories, components, and applicable packaging must be included.

  • Return authorization must be obtained before shipping merchandise.

For approved accessory returns, Keystone Spa Covers will provide a prepaid return shipping label.

Customers using an unauthorized shipping method are responsible for any shipping charges incurred unless otherwise agreed in writing.

Certain products specifically identified as non-returnable or final sale may be excluded from voluntary returns, subject to applicable law.

9. Order Acceptance and Processing

Submitting an order does not guarantee final acceptance.

An order confirmation email acknowledges receipt of an order but does not necessarily indicate that manufacturing or fulfillment has begun.

We reserve the right to review, hold, reject, or cancel orders for legitimate reasons, including:

  • Payment verification issues;

  • Suspected fraud;

  • Incorrect pricing;

  • Product unavailability;

  • Incomplete specifications;

  • Questionable measurements;

  • Shipping restrictions;

  • Violations of these Terms.

If an order is canceled by Keystone Spa Covers after payment has been collected, the applicable payment will be refunded.

Orders requiring customer clarification may experience processing delays.

Customers are responsible for responding promptly to requests for additional information.

10. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise indicated.

Payments may be processed through Shopify Payments, Shop Pay, PayPal, credit card processors, or other authorized payment providers.

By placing an order, you authorize payment collection using your selected payment method.

Customers are responsible for maintaining accurate billing and payment information.

Keystone Spa Covers is not responsible for overdraft fees, bank charges, foreign transaction fees, currency conversion fees, or other charges imposed by third-party financial institutions.

11. Sales Tax

Applicable sales taxes may be calculated and collected based on the delivery address, transaction location, and applicable tax requirements.

Customers are responsible for any additional legally applicable taxes, duties, or fees not collected at checkout, except where collection or payment is the responsibility of Keystone Spa Covers under applicable law.

12. Manufacturing and Production Timelines

Estimated manufacturing and fulfillment timelines may be displayed on product pages, communicated at checkout, or provided through customer service.

All timelines are estimates unless expressly guaranteed in writing.

Production times may vary due to:

  • Material availability;

  • Supplier delays;

  • Seasonal demand;

  • Manufacturing capacity;

  • Equipment maintenance;

  • Holiday schedules;

  • Weather events;

  • Labor availability;

  • Transportation interruptions;

  • Other circumstances beyond our reasonable control.

Keystone Spa Covers is not liable for consequential losses arising from ordinary production delays to the extent permitted by law.

This section does not limit any applicable customer rights concerning delayed shipments, required notices, order cancellation, or refunds.

13. Shipping and Delivery

Shipping availability, costs, and delivery methods vary depending on the product and destination.

Customers are responsible for providing complete and accurate shipping information.

Additional charges may apply for customer-requested address changes, failed deliveries, refused shipments, storage, redelivery, or other customer-caused transportation expenses, where properly disclosed and legally permitted.

Delivery dates are estimates unless expressly guaranteed in writing.

Customers should inspect shipments promptly upon receipt.

If a shipment appears damaged, customers should:

  • Photograph the packaging and product;

  • Retain all original packaging;

  • Document visible damage;

  • Notify Keystone Spa Covers promptly;

  • Provide relevant shipment details.

We recommend reporting visible transit damage within 48 hours of delivery to assist with carrier investigations.

Failure to report damage within this recommended period does not automatically eliminate applicable warranty or statutory rights.

14. Local Delivery

Keystone Spa Covers may provide local delivery service to eligible addresses within designated delivery zones.

Local delivery eligibility and applicable charges are determined by the delivery location and product purchased.

Delivery Location

Unless expressly agreed otherwise in writing, local deliveries are completed at an accessible location at the front of the customer's property, such as the driveway or front entrance.

Our delivery service does not include entering backyards, transporting products through homes, opening locked gates, or accessing restricted areas.

Delivery personnel are not obligated to move products to a spa's installation location.

Installation and Removal

Local delivery does not include:

  • Installation of the new spa cover;

  • Removal of the existing spa cover;

  • Disposal of old spa covers;

  • Relocation of spa equipment;

  • Assembly or installation of accessories.

Such services are available only if separately offered and expressly agreed to.

Delivery Responsibility

Customers must ensure that the designated delivery area is accessible and reasonably safe.

To the extent permitted by law, Keystone Spa Covers is not responsible for theft, loss, weather exposure, or damage occurring after confirmed delivery to the agreed-upon location, except where the loss results from conduct for which we remain legally responsible.

Customers should retrieve and properly store delivered products promptly.

15. Returns, Refunds, and Exchanges

All returns, refunds, and exchanges are governed by the Keystone Spa Covers Return & Refund Policy.

The general product categories are:

Custom Spa Covers: Final sale; no voluntary returns or exchanges.

Quick Ship Spa Covers: Eligible for returns subject to applicable deadlines and conditions. Customers pay return shipping.

Accessories: Eligible for free returns when initiated within 10 calendar days of delivery and received by Keystone Spa Covers within 30 calendar days of delivery.

Products must satisfy applicable eligibility and condition requirements.

Unauthorized returns may be refused, subject to applicable law.

Nothing in this section limits remedies required by law for defective, damaged, or incorrectly fulfilled merchandise.

16. Product Warranties

Certain Keystone Spa Covers products may include a limited warranty.

Warranty coverage, exclusions, claim requirements, and remedies are governed by the applicable product warranty and our Warranty Policy.

Coverage may vary by product.

Unless expressly covered by the applicable warranty or required by law, warranty coverage generally excludes damage resulting from:

Warranty remedies may include repair, replacement, replacement components, or another remedy provided by the applicable warranty.

Nothing in these Terms excludes or limits implied warranties or statutory remedies where such exclusions or limitations are prohibited.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KEYSTONE SPA COVERS AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, MANUFACTURERS, DISTRIBUTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF OUR WEBSITE, PURCHASE OF OUR PRODUCTS, OR USE OF OUR SERVICES.

This includes, where legally permissible:

  • Lost profits or business interruption;

  • Other indirect or consequential financial losses.

These limitations apply regardless of the asserted legal theory, including contract, negligence, warranty, tort, or strict liability, only to the extent permitted by applicable law.

Maximum Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF KEYSTONE SPA COVERS ARISING OUT OF OR RELATING TO A PARTICULAR PRODUCT, ORDER, OR SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY THE CUSTOMER FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

This limitation does not apply where prohibited by law, including where applicable consumer protection, product liability, personal injury, or other statutes prohibit such limitations.

Product Fit and Measurement Liability

Keystone Spa Covers is not responsible for losses arising from incorrect customer-submitted measurements, specifications, spa model selections, or customization choices, except where liability cannot legally be excluded.

Customers acknowledge that sizing resources and brand/model lookup tools are reference guides and do not constitute an independent verification of product fit.

Property Damage and Product Use

To the fullest extent permitted by law, Keystone Spa Covers is not liable for losses caused by improper installation, misuse, neglect, improper storage, unauthorized modifications, or failure to follow product safety and care instructions.

Spa covers are not designed to support people, pets, or other concentrated weight loads.

Customers are responsible for appropriately securing spa covers and following all applicable safety instructions.

Nothing in these Terms excludes legally non-excludable liability for defective products, personal injury, gross negligence, willful misconduct, or other protected claims.

18. Website Disclaimer

The website and its informational content are provided on an “as available” basis.

We make reasonable efforts to maintain accurate and functional website services but do not guarantee uninterrupted or error-free access.

Website features may occasionally experience outages, technical issues, maintenance interruptions, or third-party service disruptions.

To the fullest extent permitted by law, Keystone Spa Covers disclaims liability for losses arising solely from temporary website unavailability or technical interruptions.

Nothing in this disclaimer affects applicable product warranties or statutory consumer rights.
